Terms and Conditions

Introduction.

These Affiliate Programme Terms and Conditions must be read carefully and all sections must be understood and agreed to in full before applying to participate in the Affiliate Programme.

Together with your acceptance of these Terms and Conditions, you hereby reserve the right to bind the Affiliate Programme Applicant or any legal entity represented by the Applicant.

If you do not understand any part of these Terms and Conditions, please contact our Affiliate Team.

If you do not comply with this Agreement, you may not participate as an Affiliate.

We reserve the right to unilaterally terminate this agreement without prior notice if we consider an Affiliate to be in breach of or inappropriate for this agreement.

Definitions and interpretations

The term 'the Site' refers to Nortia Casino.

'We' refers to KOKEN Global System N.V., the operator of the Site.

'Affiliate Programme' means a partnership between a company and an Affiliate that pays a set commission for the purpose of marketing and inviting new Members to the Casino using the Affiliate Pattern.

Affiliate" refers to an individual or entity that registers to participate in the Affiliate Programme.

Sub-Affiliate" refers to an Affiliate who operates under the Affiliate's own control.

Player" means a customer who registers with the Site via a referral link or other means of affiliation.

Affiliate Code means an internet hyperlink from the Affiliate Site to a Website.

Chargeback" means the cancellation of a settled credit deposit by a Player.

Player Account" means an account with the Website. A Player Account must be created in order to receive Rewards.

'Commission' refers to the payment to the Partner as set out in these Terms and Conditions.

Participation in the Affiliate Programme

The Company reserves the right to refuse registration in the Affiliate Programme at its absolute discretion.

As a rule, only one affiliate account can be created. The creation of multiple accounts must be approved in advance by our Affiliate Team.

The Affiliate Programme prohibits self-affiliation except for affiliates who have been specifically authorised by our Affiliate Team.

It is forbidden to provide false personal information or to create accounts for people other than yourself without obtaining permission.

Rights and obligations of partners

The marketing activities of the Partner must be appropriate and professional and in accordance with the provisions of these Terms and Conditions.

Comply with the relevant legislation and applicable laws at all times. This includes, but is not limited to, applicable laws on data protection and privacy.

Be responsible for the maintenance and development of the partner website.

To update the Partner Website from time to time as the information on this Website is updated.

If the Partner Website contains content that is misleading to the players of the Website or to any person who has access to the Partner Website, including but not limited to players, the Partner shall be liable for any liabilities incurred and any circumstances that arise to the detriment of the Website.

Conduct business in a manner that reflects favourably on the Website.

Not engage in marketing activities (including on the partner website) that contain discriminatory, lewd, illegal, sexually explicit, pornographic or violent content.

Not target those under the legal age of gambling. Not target jurisdictions where gambling and gambling promotions are illegal.

Not use any other representation, trade mark or intellectual property rights of the Company or the owner/operator of the Website unless authorised by the Company, with the exception of marketing tools on the Website.

The Partner shall maintain the confidentiality, security and protection at all times of the login details provided by the Company. The Partner shall also be solely responsible for any unauthorised use of the login information resulting from a failure on the part of the Partner to adequately protect the login information.

Affiliate expressly acknowledges and agrees that use of the Internet and the Affiliate Programme is at Affiliate's own risk.

The operator makes no warranty as to the accessibility of the website at any particular time or at any particular location.

In no event will the operator be liable to the Affiliate or anyone else for any errors, errors, omissions, loss, injury or damage caused in whole or in part by any failure, delay or interruption of the website or the Affiliate Programme.

During the term of this Agreement, the link shall be prominently displayed on the Affiliate Website in accordance with the terms agreed between the Operator and the Affiliate.

The Operator reserves the right to monitor the Affiliate Website to ensure that the Affiliate complies with the terms and conditions of this Agreement.

The Affiliate shall provide the Operator with all data reasonably required to carry out such monitoring.

Affiliate may not register or purchase domain names, keywords, search terms or other identifiers for use in advertising, search or referral services that are similar or identical to the trade marks of the Operator and its group companies, or that contain the name of the website or variations thereof.

Affiliates will not take any action that may disrupt the relationship between the Affiliate and the Affiliate Website and the business or Website.

Affiliates shall at all times comply with the Malta Data Protection Act (as applicable from time to time), the Privacy and Electronic Communications (EC Directive) Regulations 2003 and other similar legislation.Affiliate expressly acknowledges and agrees that use of the Internet and the Affiliate Programme is at Affiliate's own risk.

Our rights and obligations

The Company shall review the submitted Affiliate application and notify the Affiliate in writing (by email) as to whether or not it accepts the request for registration in the Affiliate Programme.

The Company shall calculate the commissions generated via the Affiliate link, provide statistical data to the Affiliate and provide all customer services relating to such business.

The Company shall provide Affiliates with marketing materials and promotional information.

The Company shall pay commissions to Affiliates on traffic generated in accordance with the terms and conditions of this Agreement.

The Company reserves the right to close an Affiliate's or Player's account.

The Company may reject any player or close any player's account if the Company, in its sole discretion, deems it necessary to comply with the Company's operating policies or to protect the interests of the Company.

Hype and lies are prohibited. If it is discovered that a player has been led to our site through fraudulent activity, we shall close the affiliate account and freeze the payment of commissions for the duration of the investigation. We reserve the right to withdraw commissions and suspend future commissions if a breach of contract is found.

Spamming is prohibited by the affiliate. We reserve the right to close an affiliate's account if spam advertising is found.

Payment.

Commission payments are made to designated player accounts.

Commissions for the 1st to 15th of the month will be paid on the 17th of the month; commissions for the 16th to the end of the month will be paid on the 2nd of the following month.

The following 1st-15th will be considered as the first school and the 16th to the end of the month will be considered as the second school.

The minimum commission withdrawal amount is $100.

When requesting a withdrawal, it is possible to go up to a whole number before the decimal point.

Withdrawals are made through the player account.

After the application has been submitted, it will be reviewed by the system and, if it passes the review, the money will be transferred to the designated player account. The review process takes a certain amount of time.

Commission payments are based on a negative carry-over system, which means that if the negative balance is caused by the game results of the referred player, the negative balance will be carried over to the next cool (first or second). Payments are made when the income from the previous cool (First or Second) has a positive balance, offsetting the negative balance carried over from the previous month.

The formula for calculating commissions is as follows

(win value (bet amount - payout) - bonus cost - platform cost - jackpot - commission) x commission %.

*Payout: the amount won by the child member.

If there is not a single active child member within three consecutive months, you will be deemed inactive and all commissions in the system wallet will revert to zero.

If you fail to gain an active child member within six consecutive months, your account will be frozen and all commissions in the System Wallet will revert to zero.

Commissions can be withdrawn directly. You can also play with the commission amount.

If you wish to withdraw your commission after you have played the game, you will need to provide proof of identity.

You agree to return all commissions received based on fraudulent or false transactions and indemnify all costs and losses (including but not limited to legal fees and costs) incurred in connection with such transactions.

Partners must refund in full any commissions received on the basis of fraudulent or erroneous transactions.

Cancellation or termination of contract

Affiliates may terminate by notifying the Company's Affiliate Team by email. This Agreement shall also automatically terminate if the Company is no longer able to provide online gaming services to its customers through the Website.

In the event of any of the following events, the Company may terminate the account registration of the affiliate in question and terminate the affiliate without any notice or consent.

If the Affiliate is found to be in material breach of the Terms and Conditions.

If an affiliate is deemed to be engaging in illegal activities.

When the Company becomes aware of the death of an affiliate

When an affiliate has not earned commissions for a period of one year or when we consider that the affiliate has substantially ceased to be active as an affiliate for a continuous period of one year.

Affiliate agrees to the following upon termination of this Agreement

1. Affiliates are required to remove all trademarks (banners, logos, etc.) belonging to the Company, whether for marketing purposes or not.

2. The Affiliate must return to us the original data (and all copies and derivatives) containing all confidential information in the Affiliate's possession, custody, or control, or permanently erase any copy data containing such information.

3. The Affiliate shall be entitled to receive only unearned and unpaid commissions as of the effective termination date of this Agreement. However, we may withhold on the final payment to the Affiliate within a reasonable period of time necessary to confirm payment of the exact amount due. Affiliates are not eligible to earn or receive commissions after the effective termination of this Agreement.

Revision of these Terms of Use

We reserve the right, at any time and in our sole discretion, to revise, modify, delete, or add provisions to this Agreement without prior notice. The Affiliate Team will be notified of any revisions to the Terms and Conditions by email. Continued participation in the Affiliate Program following the Company's publication of any modification or change will constitute the Affiliate's acceptance of the new Terms and Conditions.

Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Curacao. Any litigation concerning these Terms and Conditions shall be referred to and decided by Curacao's arbitration body.

Indemnification

The Affiliate hereby agrees to hold harmless the Company and shall indemnify the Company and its subsidiaries and vendors, its officers or agents for any loss incurred by the Affiliate in the event of the Affiliate's violation of these Terms of Use.
